
LEAVES AND CONDITIONS ON LEAVE
All kinds of leaves will have to comply with the Work Rules and Regulations.
Application For Leave
a) Employees who need to take leave will submit the Leave Form, stating the reason for leave, to their supervisor and department manager for approval.
b) Other than Sick leave, all application for leave must be submitted for approval at least 3 days in advance, except as specified below.
c) After approval by department manager, employees will have to send in their Leave Form to Administration Department within one working day. Administration Department must have the approved Leave Form before the employee takes leave.
d) For sick leave, employees must submit Leave Form to department manager for approval on the first day they return to work. The approved Leave Form will have to be sent to Administration Department for processing within one working day after approval.
e) A leave without approval will not comply with the Work Rules and Regulations and will be considered as absence from work and will be without pay. Depending on the case, further disciplinary action may be taken.
Absence & Leave
Leaves can be divided into the following kinds:
Sick Leave
There are two categories of Sick Leave, as follows:
a) Sick Leave (not concerning work):
i) If employees are sick, they are entitled to take sick leave with pay for not more than 30 work days per year. Sick leave over 30 working days will not be paid. Employees taking sick leave without illness will be punished according to the Company’s regulations.
ii) For sick leave of 3 consecutive work days or more, they must submit a medical certificate issued by a qualified and registered doctor or a government hospital together with the Leave Form. In case no such certificate can be provided, the employee’s leave will be considered as absence from work.
iii) In case the Company provides a physician, such physician will issue the medical certificate, unless the employees are unable to be examined by such physician.
iv) For every sick leave, employees must try to submit the Leave Form or telephone to inform their supervisor of the leave as soon as possible, either before or during the leave. If this is not possible, they must submit the Leave Form to the supervisor and then the department manager for approval on the first day of their return to work. The Company will consider the employees absent from work, in case they fail to comply with the stated rules.
b) Special Sick Leave (concerning work):
i) Employees who are injured or sick because of work for the Company will be granted a Special Sick Leave, besides those specified above. This leave will not be considered as sick leave.
ii) The doctor will decide the number of leave days due to the injury or Illness.
iii) This Special Sick Leave will be with pay, even it goes beyond 30 days.
Maternity Leave
Female employees, who are pregnant, are entitled to take Maternity Leave before and after delivery of not exceeding 90 days, inclusive of holidays during the period for each pregnancy. Wage, which is equal to the rate paid on regular working days for the actual number of leave days, will be paid, but not more than 45 days, inclusive of holidays (exclusive of Sick Leave stated in Clause 9.2.1 A).
Military Service Leave
a) Male employees will be granted leave to participate in military service, as per requirement under the law, with pay for actual number of leave days taken, but not more than 60 days in a year and not more than one time during his lifetime.
b) Employees who need to take military leave will have to submit a copy of summons and a Leave Form to the supervisor and department manager for approval 7 days in advance. Leave can only be taken after approval is given.
c) If the employees fail to return to work or report to the Company within 3 working days after the leave expires, the Company will assume that the employees do not intend to work for the Company further and will terminate the employment without the severance pay.
d) Military Service Leave for more than 60 days a year will be considered as leave without pay.
Training Leave
a) Employees may be considered for leave for training, improving direct working knowledge and skills.
b) The detailed procedure for applying Training Leave for Company sponsored programs will be as per Company’s MIL-QP-G09 Training and Development Procedure. Training Leave for Company sponsored program will be with pay.
c) Employees may also apply for Training Leave for programs not sponsored by the Company. Details will be as per “Policy And Procedure for Granting Special Arrangement On Employees Who Pursue Advance Education” dated November 11, 1995.
d) Training Leave must be applied and approved before the training starts. Applications after training starts will not be considered.
Monkhood Leave
Employees are allowed Monkhood Leave with pay of not more than 7 days. This leave can only be taken one time throughout the whole employment.
Sterilisation Leave
Both male and female employees are entitled to Sterilisation Leave with Pay. The period of leave will be as per medical certificate issued by the registered doctor.
Personal Leave (Without Pay)
a) Any leave, other than those stated above, will be considered as Personal Leave. All Personal Leave will be without pay.
b) Employees, who intend to take Personal Leave, will have to submit Leave Form to their supervisor and department manager 3 days in advance for approval. The Leave Form must state reason for taking the leave.
c) In case the employees cannot submit the Leave Form for approval in advance, they must submit the Leave Form to supervisor and department manager for approval on the first day of their return to work. A Personal Leave without approved Leave Form will be considered an absence from work.
d) A Personal Leave, if approved, will be considered as leave without pay.
e) A Personal Leave, if not approved, will be considered as absence from work.
Special Personal Leave
Employees are entitled to take Special Personal Leave with pay for not more than 4 days per year. This leave will be allowed for the following reasons:
a) Leave for funeral of the family members who are father, mother, spouse, children and directly related brother or sister.
b) Leave to get married.
c) Leave to handle personal affairs due to calamities that happen directly onto the employee such as fire, flood, storm, etc.
d) Leave to contact the government agencies where the employees must go by themselves, e.g. to apply for identity card or driving license, go to the court, etc.
e) Leave to attend the childbirth of the employee’s legitimate and lawful wife.
For the leave as stated in (a) and (b), the Company will grant a leave of 3 days. For (c), (d) and (e), the leave granted will be one day, or as approved by the department manager.
